Reader’s Question:

How many points does it have to be on your driving record before they suspend your drivers license? I live in fort Worth Texas.

Sam

Fort Worth, TX

Your license will be suspended in Texas if you have what they term “habitual traffic violator”. The meaning of this is an individual who receives four or more traffic violations in a period of 12 months or has 7 or more moving violations in a period of months. If you receive and are convicted of this many infractions you are subject to have your license suspended according to the transportation code 521.292.

You can verify with TX department of public safety to check if there is also a point limit or just the number of violation convictions as listed above.

Reader’s Question:

I received a speeding ticket in IL and I am wondering if this will this affect my insurance rates in Fort Worth, Texas?

Jim

Fort Worth, TX

Your home state of Texas and Illinois are both members of the Drivers License Compact (DLC) so if you plead guilty and were convicted of the speeding infraction then the TX Department of Public Safety (DPS) will be notified.

The Texas Department of Public Safety states that they will place out of state violation onto your TX driving record. The Texas points system lists that it is two points for a moving infraction conviction in Texas or that in another state. However, points are not assigned for speeding less than 10% over the posted limit or for seat belt infractions.

Since the Illinois speeding violation will be placed on your Fort Worth TX driving record your insurance carrier will see it the next time they pull your MVR. To verify if this Illinois speeding ticket will affect your rates in Fort Worth Texas you would need to find out about your specific insurance carrier’s rating system. You can find out about a rating system usually by asking your agent or the TX TDI since the insurance company’s rates are filed with this state agency.

Reader’s Question:

I live in Fort Worth TX and I found out your license is suspended in Texas for a no insurance ticket, how much does it cost to get it back?

Penny

Fort Worth, TX

To reinstate your license after a suspension for driving without insurance there is a reinstatement fee due prior to the renewal/issuance of a driver’s license. You must also get a proof of insurance (form SR-22) from an insurance company and submit it to the Texas Department of Public Safety (DPS). The SR-22 financial responsibility certificate is required for 2 years from date of conviction.

The reinstatement fee I think is around $100 to $125. There will also be a driver responsibility surcharge included. Motorists who receive a conviction for certain offenses that happen on or after September 1, 2003 are required to pay an annual surcharge for 3 years from the date of conviction. If you fail to Maintain Financial Responsibility it comes with a $250 annual surcharge.

Reader’s Question:

I live in Forthworth TX. How long do you have to carry sr-22 insurance in my state?

Harrison

Forthworth, TX.

Normally, you have to get and carry an SR-22 for two years in Texas.

The TX Department of Public Safety states that, the SR-22 is required for two years from the date of accident, date of conviction or date the judgment was rendered. You can check the law regarding this under Texas Transportation Code 601.056.

You do not have to have your own car to purchase this kind of car insurance policy. If you do not own a car, you may call an insurance provider or agent of your choice and speak to them about a non-owner SR-22. However, you do need to get the car insurance policy and SR22 form from an insurance agent who is authorized to write liability insurance for the State of Texas.

Reader’s Question:

I do not drive or have my own car so I dont understand why I need an sr22. I live in FT Texas.

Kelly

Thank you for asking Kelly.

Many times a SR-22 is required of a drivers after being convicted of certain moving violations of the law and especially at the time the motorist wants to get their drivers license reinstated.

If the state isn’t requiring you to buy an SR22, you don’t need to buy an SR22. Whether you are going to drive or own a motor vehicle normally does not matter if the state is mandating that you maintain a SR22 as a condition of your license being reinstated. The SR22 is showing that you will have financial responsibility if you do drive.

If you do not own a vehicle, you may get a non owners sr22.

To get more information why you specifically are being required to maintain an SR-22 you would need to contact the Texas DPS or other TX agency that notify you to maintain an sr22.

Reader’s Question:

My nephew’s license was suspended because of ALR hearing. Will he gets his license back once he gets an sr22? He lives in Forth Worth, TX.

Louie

Thank you for asking Louie

In Texas, the ALR went into effect on January 1, 1995. According to the TX DPS website this program is the administrative process by which the Department of Public Safety suspends the driver licenses of individuals who are arrested for the offense of driving while intoxicated (DWI). The TX DPS website goes on to say that an individual may be suspended if he/she either refused to submit to a chemical test or provided a specimen with an alcohol concentration of 0.08 or greater. The DPS is also authorized to suspend the driver licenses of minors who commit the offense of driving under the influence (DUI).

In TX, a driver with suspended license in a ALR hearing will receive information from the DPS regarding reinstatement of drivers license. It is necessary to follow the instructions carefully provided by DPS because the license is not reinstated automatically after the period of suspension is over.

Reader’s Question:

I am required to carry an sr22, is it possible if I keep my current insurance coverage and get an sr22 as well? Is it also true that insurance is cheaper for married couple?

Lorna

Thank you for asking Lorna.

If you already have a car insurance policy, you can not buy a separate policy for an SR-22. You will need to terminate your current insurance policy if your insurance provider does not offer an SR-22 and buy an insurance policy with an insurance carrier that does.

Generally, regular car insurance can be cheaper for married couples. This may not always be the case though if you as an individual had a clean driving record but when you marry your spouse has a driving history with a “bad” driving record. Your rates may be higher due to the motor vehicle record of another person on your policy with you.

Reader’s Question:

We live in Forth Worth and my son was required to get an sr22? What is it and how do we cancel it?

Paula

Thank you for asking Paula.

According to the Department of Public Safety website an SR-22 insurance policy is a certificate of insurance that shows proof of insurance as required by law. SR-22 insurance is not necessarily “high risk” insurance. The DPS goes on to say that it is motor vehicle liability insurance which requires the insurance provider to certify coverage to DPS, and the insurance provider must notify DPS anytime the policy is cancelled, terminated or lapses.

Once the Texas Department of Public Safety (DPS) receives notification from the insurance provider that the policy is cancelled, terminated, or lapses appropriate action may be taken. If there is not a valid SR-22 on file when you are still required to maintain it, the driving privilege will be suspended

An SR-26 form which must be filed by the insurance company to terminate the SR-22.Your son needs to inform his insurance provider to remove it if he no longer needs it. Some insurance company may want him to show documentation from the DPS that shows that he no longer needs an sr22. Your son should contact the DPS to verify if he no longer needs to maintain sr22.

Reader’s Question:

What is an sr22? What if I dont maintain it? I live in Forth Worth TX.

Isabelle

Thank you for asking Isabelle

According to the TX DPS website ,Texas statute TRC CH. 601.340 provides a Safety Responsibility Law or Evidence of Financial Responsibility Law, for individuals whose driver license or privilege has been suspended or revoked.

In order to reinstate driving privileges, a person is required to file and maintain insurance in the form of an SR-22, original pink copy, with the Department. SR-22 insurance is mandatory for a period of two (2) years from date of conviction.

In addition to that a reinstatement fee is also required with the SR-22. Within the two-year time frame, if the Department receives notice from the insurance provider that insurance coverage has been canceled, terminated or lapse, suspension action will be taken.

According to the DPS website, an SR22 in Texas is an insurance policy that requires proof of insurance ,a certificate filed with the Texas Department of Public Safety. This is required of those convicted of drunk driving or DWI conviction in the state of Texas.

SR22 form provides a guarantee to the Texas DPS (Department of Public Safety) that the motorist has the state required amount of coverage. If the policy is cancelled, terminated or lapse of coverage, the Texas SR22 filing requires the insurance company to notify TX DPS. Upon notification the Texas DPS will suspend the drivers driving privileges and drivers license.

SR22 insurance coverage in is normally required for a period of 2-3 years from the date the drivers license was re-instated after a Texas DWI offense in the state of TX. You will need to verify with the Texas DPS to make sure of your specific SR22 insurance requirements. This is normally mailed to an individual in a certified letter from DPS when your TX drivers license is first reinstated.

You will have to shop with a insurance agent who can show you all available policies available to you. There should never be an obligation to select any of the insurance policies presented to you. Once you take a look at all available policies so you may be able to check which insurance policy and insurance company is right for you.
