In Texas, the ALR went into effect on January 1, 1995. According to the TX DPS website this program is the administrative process by which the Department of Public Safety suspends the driver licenses of individuals who are arrested for the offense of driving while intoxicated (DWI). The TX DPS website goes on to say that an individual may be suspended if he/she either refused to submit to a chemical test or provided a specimen with an alcohol concentration of 0.08 or greater. The DPS is also authorized to suspend the driver licenses of minors who commit the offense of driving under the influence (DUI).
In TX, a driver with suspended license in a ALR hearing will receive information from the DPS regarding reinstatement of drivers license. It is necessary to follow the instructions carefully provided by DPS because the license is not reinstated automatically after the period of suspension is over.
